‘Spend and Win’ terms and conditions 

  • By entering the Spend and Win competition (competition), you acknowledge that you have read these terms and conditions and that you agree to be bound by them. Information on how to enter forms part of these terms and conditions.
  • This competition is being run by Australia Pacific Airports (Melbourne) Pty Ltd ABN 62 076 999 114 of APAM Management Office, Terminal 4, Melbourne Airport, Tullamarine, Victoria 3043 (Promoter).

WHO CAN ENTER?

  • To be eligible to enter the competition you must:
  • reside in Victoria; and
  • be over the age of 18; and
  • have a valid boarding pass; and
  • spend, and have proof of (in the form of a receipt), any dollar amount, at a Melbourne Airport retailer in Melbourne Airport Terminals 1, 3 or 4 during the campaign period.

  • Employees, directors or officers of the Promoter, any companies or agencies associated with this competition, or their immediate families, are ineligible to enter.

HOW TO ENTER

  • The competition period commences at 4:00am AEDT on 07 March 2025 and ends at 9:00pm AEST on 30 April 2025 (Campaign Period), and the Promoter reserves the right to extend the competition end date at any time (subject to regulatory approval).
  • To enter the competition, you must purchase an item or good from any retailer in Melbourne Airport terminals 1, 3 or 4 (there is no minimum spend), visit our website https://promo.melbourneairport.com.au/spend-and-win/ and enter your details and the details of your purchase during the competition period.
  • No late entries will be accepted. Incomplete or incoherent entries will be invalid.
  • A limit of one entry to the competition per person applies.
  • The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, employer, residency status/location and transaction value) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process.  In the event a winning entrant cannot provide proof of eligibility to the reasonable satisfaction of the Promoter, the winner will forfeit the prize in whole and no substitute will be offered. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

PRIZE

  • The prize is a $20,000 voucher for flight centre valued at $20,000 as at the publishing date of these terms and conditions. The total prize value is $20,000.
  • Travel Insurance is not included in the prize and we strongly recommend it is taken by the winner before travel.
  • Availability of flights cannot be guaranteed during peak periods including but not limited to the Christmas period, school holidays or special event periods.
  • All travel must be booked within 12 months from the date the winner is notified that they have won the prize. The Promoter makes no representation as to the safety, conditions or other issues that may exist in transit or at any destination.
  • If for any reason the winner does not travel (or redeem any part of the prize) after making a booking, then the prize (or that element of the prize) will be forfeited.
  • The prize does not include any costs associated with redeeming that cannot be purchased through flight centre such as additional travel, meals, spending money or taxes.
  • The prize will not be transferable to another person.
  • No part of a prize is exchangeable or redeemable for cash or any other prize.
  • If a prize is not available for any reason, the Promoter reserves the right to substitute the prize with another item of equal or greater value if the winner agrees in writing and subject to any approvals from regulatory authorities.  If the winner does not agree despite reasonable attempts by the Promoter to reach an agreement and the prize is not available due to circumstances beyond the Promoter's control, the Promoter may substitute the prize with another item or items determined by the Promoter to be of equal or higher value.

SELECTION OF WINNER

  • The winner will be chosen by random draw which will take place at 10.00am AEST on 16 May 2025 at Melbourne Airport.
  • The first valid entry drawn will win the prize as described above. 
  • The winner will be personally notified and the name of the winner will be published on https://promo.melbourneairport.com.au/spend-and-win/.
  • The results of the draw will be final and binding and no correspondence will be entered into in relation to the results of the draw.  This is a game of chance.
  • The winner must provide proof of purchase on notification of winning to receive the prize.
  • The Promoter must distribute the prize to the winner within 28 days of the draw.

SECOND CHANCE DRAW

  • If a winner does not respond within one month of being notified that they have won the competition, that winner is not readily identified and reasonable efforts have been made by the Promoter to identify the winner were unsuccessful or the winner is unable to provide proof of purchase, they will automatically forfeit their prize and the Promoter reserves the right to select another winner through a second chance draw.
  • If necessary, a second chance draw will be held on 30 June 2024 at the same time and place as the first draw.  The first valid entry drawn will win any unclaimed prize. 
  • The winner will be personally notified and the name of the winners will be will be published on https://promo.melbourneairport.com.au/spend-and-win/.
  • The results of any second chance draw will be final and binding and no correspondence will be entered into in relation to the results of the draw.
  • The Promoter must distribute the prize to the winner within 28 days of the draw.

PROMOTION AND MARKETING

  • By entering the competition, the winner/s agrees to participate in such promotional activity and material, all editorial activities relating to the promotion, including but not limited to being interviewed, filmed for broadcast and photographed, as the Promoter may require without remuneration. The winner/s agree to grant the Promoter a perpetual and non-exclusive licence to use any such footage and photographs in all media worldwide and the winner/s (and their companion) will not be entitled to any fee for such use.
  • Each winner also consents to the use and publication of their name, image and any other details provided by the winner in any marketing material without any further reference or payment to the winner.

STANDARD TERMS

  • The Promoter reserves the right to amend the competition and its terms and conditions at any time and for any reason, subject to regulatory approval, and will notify entrants of any such amendments as soon as reasonably practicable.
  • In the case of an intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism and pandemics, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions at a time suitable to the Promoter, subject to any written direction given under State Regulation.
  • Nothing in these terms and conditions limits, excludes or modifies or purports limit, exclude or modify the Promoter's liability in relation to the consumer guarantees under the Australian Consumer Law (ACL) (Schedule 2 of the Consumer and Competition Act 2010 (Cth)) (Non-Excludable Guarantees Liability).
  • Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees Liability, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the competition including:
  • any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
  • any theft, unauthorised access or third party interference;
  • any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  • any variation in prize value to that stated in these terms and conditions;
  • any tax liability incurred by the winner or entrant; or
  • use of the prize.
  • To the extent permitted by law including the ACL, if the competition is not capable of running as planned including by reason of technical failure, fraud or any cause beyond the Promoter's control, the Promoter may cancel or suspend the competition or invalidate any affected entries, subject to regulatory approval.
  • Please read the Promoter's privacy policy available on the Promoter website at https://www.melbourneairport.com.au/privacy-policy which tells you how we use any personal information we may collect about you by entering a competition.
  • The Promoter may, for an indefinite period, unless otherwise advised, collect personal information through the competition and use and disclose the information to conduct the promotion and for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant and any other purpose set out in the Promoter's privacy policy. Entrants should direct any request to opt out, access, update or correct information to the Promoter. Personal information collected through the competition includes first name, last name, contact phone number, email address, postcode and date of birth. The Promoter may disclose personal information to subsidiary and related companies, third parties or regulatory bodies, including but not limited to agents, contractors and service providers for the purposes set out in this clause.
  • The Promoter is not liable for any tax implications arising from prize winnings, including fringe benefits tax.  Independent financial advice should be sought.
  • The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter reasonably believes has breached any of these terms and conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this competition.  Any entrant disqualified under this clause is prohibited from any further participation in the competition.  The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  • The laws of Victoria apply to this competition.  Entrants submit to the exclusive jurisdiction of the laws of Victoria.
